The Role of the Collaborative Divorce™
Family Lawyer:
In the collaborative process, each of the divorcing spouses has
a lawyer committed to their needs. The lawyers agree in advance
to set aside adversarial strategies and preparations for trial,
while at the same time maintaining their duties of advocacy and
loyalty to their individual clients. They are then free to work
toward positive, family-friendly solutions without the burden
of preparing for trial. If the collaborative process is not
successful, the collaborative lawyers must withdraw from the
case and refer their client to a trial
lawyer.
Each Lawyer
will…
1. Represent
the best interests of his/her respective client while
maintaining the overall goals of the Collaborative
Process.
2.
Work with the other attorney and the Collaborative Team
to help the parties design the settlement agreement that is
most appropriate for their family.
3. Facilitate
the settlement discussion and incorporate client agreements
into the final settlement documents.
4. Prepare all
the documents that need to be filed with the
Court.

John was born in Pennsylvania and grew up in Stanly County,
North Carolina. He received his BA in History from Davidson
College in 1993 and his JD from West Virginia University in
1996. He has maintained a general law practice in
Cornelius/Davidson since 1996, emphasizing family law. His firm
also handles most areas of law including, real estate,
criminal, corporate, traffic, and general civil litigation. He
practices in Mecklenburg, Iredell, Cabarrus and Lincoln
counties. He lives in Lincolnton on a 36-acre former horse farm
with his wife, Susan and son, Trey.

Laura Snider Baker has been a licensed
attorney in North Carolina since 1995. She is a North Carolina
native and received her undergraduate degree from Wake Forest
University in 1991 and her law degree from Campbell University
in 1995. She lives
in Cornelius with her husband and two
children.
Laura is a principal with the firm of Baker
and Baker, PLLC.

Huntersville, North Carolina. Laura’s practice consists
primarily of family law cases. While she prefers to handle
family cases through collaborative law or mediation, she does
appear in court in Mecklenburg, Iredell, Lincoln and Cabarrus
counties on family law cases on a regular
basis. Laura
has been practicing family law in this area since
1995. The
firm also handles real estate transactions, wills, trusts
and estates, as well as some general civil
litigation.
